Legal

The Agreement

  • This agreement starts when you register with ReVmail online, you will be asked if you have read and accepted these conditions.

  • This service is ONLY AVAILABLE IN AUSTRALIA FOR AUSTRALIAN MOBILES.

  • Kensler will provide you (reference to "you" or "your" mean the CUSTOMER) with either:

    • A dedicated Sydney DID number (an 02DIRECT number) that can be used to receive voicemail calls and/or

    • A ReVmail account regsitered with your mobile phone number and other numbers

  • The account will have a credit balance which will be debited as you use the service. You will need to topup the balance to keep on using it.

  • If you decided to change or cancel your service Kensler must be notified as early as possible by email or phone call and at least 15 days in advance

  • If you cancel your account or service, any prepaid balance or monthly service fee in advance will NOT be refunded

  • Kensler will attempt to make it's service available to the customer at all times, but there are some factors such as weather and faults in the phone network that may cause the service to become unavailable. Under these unforeseen circumstances Kensler will not be liable for any loss of business or revenue to Kensler’s customer.    Kensler will do its best to keep service disruption to a minimum but there may be times where system upgrades or maintenance will need to take place.

 The Beta Trial (October 2009)

  • The Revmail Beta Trial is being run to test the technology and obtain constructive feedback from the trial users. You will be provided a free Revmail $ balance on registration which can be used to acces ReVmail services only. No refunds will be provided. You have no obligations to use the service.

  • We request that you inform us of any bugs or issues you encounter by filling in the Bugs form on http://bugs.revmail.com.au. We also ask that you complete a survey form to help us improve the service, see: http://survey.revmail.com.au .

  • The trial will complete when your balance is too low or on the 30th October 2009 (whichever comes first) and the service will no longer be available unless you have specifically contacted us and we have agreed to continue the service for you.

The Service

  • ReVmail is a shared service, that is the equipment and network are shared with other customers; it is therefore possible for another customer’s traffic to temporarily use all of the available resources. Kensler will always work to reduce this risk by limiting the resource but there are some areas outside of our control. If a dedicated service is required Kensler can provide this at extra cost.

  • With a ReVmail account you can call 1300448738 (1300 GiVReV) and deposit a voice message for any mobile number in Australia. The recipient number will be sent a text message to let them know they have a ReVmail, unless they have opted to NOT receive text messages.

  • You may then view the status of this message (whether read or not) and may recall the message (delete) if it has not been read.

  • You may send a voice message to multiple numbers

  • You may opt to receive a text message when the message is read

  • You may also receive ReVmail messages from other people

  • You may listen to your messages by phone or web page or get them sent to you by email in WAV format.

  • If you listen to a message the sender may receive a read recipt indicating you have read teh message.

  • Voice messages will be kept for 3 days whether read or unread, after which they will be deleted

  • Voice messages may only be a maximum of 2 minutes seconds in duration unless you have a dedicated DID.

  • If you wish to use ReVmail as your dedicated voicemail service by diverting your calls from your mobile, then you will need to request a dedicated Direct InDial service (DID).

  • You may store contact information in your ReVmail account and associate a short dial (2 digit number) so that you do not need to remember their full mobile number.

Liability

  • To the extent permitted by law we exclude all liability to you or any other person claiming through you, for any costs, loss, expenses, liability or damage. You must accept all liability and indemnify Kensler from any action that relates to any form of misconduct or illegal operation of the ReVmail service

  • Kensler is not liable for any cost’s or loss that may be incurred due to the cancellation of your service.

Termination of Service

Kensler reserves the right to terminate your service with out notice for any of the following reasons :

  • You have given Kensler false or misleading information about your self or your company.

  • Your service does not comply with Kensler's terms and conditions

  • Your account balance has reached zero or gone over the credit limit agreed to by Kensler and you the customer.

  • Kensler may also terminate your ReVmail service if your prepaid balance has been zero balance for longer than 60days, or you do not pay your bill within 30 days after the invoice.

  • Kensler may terminate your Prepaid ReVmail service if it is no longer ACTIVE. A service is considered ACTIVE if it has received at least one call in every 30 days and the prepaid balance is positive.

Account payment terms - Payment for your Call Manager service is either:

Prepaid in advance

  • If there is insufficient balance on the account then the ReVmail will be cancelled..

  • ReVmail charges may deducted from the balance for each revmail sent or received or for other actions such as email delivery

Postpaid - Invoiced monthly (on request only and subject to conditions)

  • Invoices will be emailed to the primary contact email address

  • Payment must be made within 14 days of an invoice being sent

  • Monthly service fee is charged in advance and must be paid prior to the service being used

  • Call  charges are billed in arrears

  • The customer is responsible for keeping the primary email address accurate  

Call Charging

  • Calls rates as per Kensler’s latest advertised rates.

  • Calls are charged in 30 second increments unless otherwise specified.

Confidentiality and Privacy

  • Kensler Pty Ltd is bound by the National Privacy Principles as set out in the Privacy Act 1988 and the Privacy Amendment (Private Sector) Act 2000. We also believe profoundly in maintaining absolute alignment with this act.

  • Kensler will keep all customer information confidential and will not pass any information onto a third party with out your consent.

  • Kensler collects personal information about you, in order to provide personalised information services.

  • The type of personal information we collect may include your name, postal and email addresses, telephone numbers, information on how you use our products and services, such as the type, date, time, location and duration of calls, or other communications. The numbers you call and your payment amounts. This information permits us to issue accurate bills and also helps us develop products to suit your needs.

  • How we may use your Personal Information

  • The personal information you provide Kensler may be used for a number of purposes connected with our business operations, which include:

• processing your orders or applications;

• carrying out credit checking and scoring (unless we have agreed otherwise);

• providing you with products and/or services requested;

• billing you or administering your account;

• dealing with requests, enquiries or complaints and other customer care related activities;

• carrying out market and product analysis and marketing Kensler products and services generally;

• contacting you about our group companies' products and services;

• registering your details and allocating or offering you rewards, discounts or other benefits and fulfilling any requests or requirements you may have in respect of our and our group companies' loyalty or reward programmes and other similar schemes; and

• carrying out any activity in connection with a legal, governmental or regulatory requirement on us or in connection with legal proceedings, crime or fraud prevention, detection or prosecution.

  • We may also use your personal information for purposes related to those described above which would be reasonably expected by you. For example, we may use your personal information to keep you informed about features of our services or conducting analysis in order to provide better service to you. Please note that Kensler will still need to send you essential information about your account or changes to your service.

 

  • We will not use your information for purposes other than described above unless we have your consent or there are specified law enforcement or public health and safety reasons.

 

Sharing your Personal Information

  • Kensler may disclose or receive personal information or documents about you to/from:

i. credit providers or credit reporting agencies for the purposes permitted under the Privacy Act;

ii. law enforcement agencies to assist in the prevention of criminal activities;

iii. our service and content providers, dealers and agents, or any company within the Kensler group for purposes that are related to providing you with a telecommunications service which would be reasonably expected.

  • Unless you consent, we will not disclose your personal information to third parties, other than those who have contracted with Kensler to keep the information confidential, or who are subject to obligations to protect your personal information.

Security of your Personal Information

  • We will take reasonable steps to ensure that the personal information we collect, use or disclose is accurate, complete, up-to-date and stored in a secure environment protected from unauthorised access, modification or disclosure.

  

How to access your Personal Information

  • Upon your request, Kensler will take reasonable steps to let you know, generally, what sort of personal information we hold, for what purposes and how we collect, use and disclose that information.

  • Upon your request, Kensler will provide access to your personal information we hold, except in certain prescribed circumstances, including emergency situations, specified business imperatives and law enforcement or other public interests.

  

General

  • Kensler can change the terms and conditions at any time, including, without limitation, by withdrawing any product or service offering. If we do this and the change is to your detriment, we will let you know either by email, post, phone or placing an advertisement on our website.
